WARRANTY   CLAUSE

[ COMPANY means ‘SKS Engineers’ and CUSTOMER means Customer to whomsoever Equipment has been sold as per invoice ]

S. K. S. Engineers undertakes as its sole warranty in respect of the Equipment  supplied by it vide relevant invoice to make good by repair or replacement, at its option, to be carried out the company or by its engineer / representative, free of all charge, any defects in the said ‘Equipment’ arising in the company’s opinion from faulty materials or workmanship which shall become apparent with in a period of one year from  the date of  commissioning or fifteen months from the date of dispatch of the equipment whichever is earlier.

The above sole warranty is subject to the following:

1. Warranty is applicable to Domestic Sales only. The equipment or part shall be sent to the  

Company’s works at New Delhi for making it good. Incase onsite repair is required the company shall depute its representative to the registered address of the customer in India.

The repair / replacement shall be free of charge but the customer has to bear the cost of to & fro travel , boarding, lodging and local travel of the representative.

2. SKS Engineers  Warranty does not extend to failures, defects or damage attributable to wear and tear, improper adjustment, neglect, misuse, mishandling , alteration of specification or accident.

3. All defective Parts must be returned by the Customer to the Company immediately together with full particulars of the defect.

4. SKS Engineers warranty does not extend to proprietary or other components not of it's manufacture but the Company will so far as it is able to do so under the terms of any such warranty at the time of the Customer's request for the same pass on to the Customer the benefit of any warranty in respect of proprietary items or components not of SKS's manufacture.

5. In the event of the rejection by the Company of any claim the Parts returned will be destroyed unless specific instructions to the contrary were given.

6. SKS Engineers accepts no responsibility for damage by fire or accident of any kind to any Equipment returned to the Manufacturer under the terms of the Company's Warranty, nor does the Company, accept responsibility for any accident occurring to such Equipment whilst on its or their premises.

7. SKS Engineers warranty shall cease to have effect if any marks, any component, affixed to any SKS Equipment are removed, defaced, altered or tampered with.

8. SKS Engineers Warranty shall be applicable only if the Equipment is erected and commissioned under the supervision of the service engineer of the company  and  the Equipment is operated as per the guidelines provided by the company through service engineer and or contained in the operators manual.  Warranty will not be applicable incase of any mishandling  / maladjustment of the equipment.

9. Only the parts/components supplied / suggested by the manufacturers are used and incase a

              non standard components is used , the warranty shall become null and void.

10.    Only specific / recommended grade of oils will be used in the crane.  Incase oil of lower or

         higher grade is used it may affect the performance of the equipment and its component and

         warranty shall not be valid.

11.    The warranty shall be applicable to the original buyer of the equipment.  Incase the

         equipment is sold or transferred otherwise to any third party without written consent of the

         manufacturer the warranty shall become null and void.

12. The warranty of the equipment will cease incase damage is caused to equipment through

      any accident or otherwise.

Extent of Liability

1.  SKS Engineers liability in connection with the Goods shall in no circumstances exceed their 

     invoice price.

2.   The Customer's acceptance of delivery of the Goods shall be conclusive evidence that the    Consumer has examined the Goods and found them to be complete, in accordance with the    description on the Sales Order or as agreed in writing between the parties, in good order and    condition and fit for the purpose (if any) for which they were supplied unless brought to the notice of SKS Engineers within  7 days from the date of receipt of equipment by customer or 10 days from the date of dispatch whichever is earlier.

General

1.      Work on any materials (including "free-issue" items) supplied by the Customer is carried out by the Company on the express understanding that the Company accepts no responsibility for any distortion, faults, errors or defects which arise during or as a result of the work from any cause whatsoever including any mistake or negligence on the part of the Company except that subject to the availability of capacity and facilities the Company will endeavour to correct or re-perform any such work at the Customer's expense and risk.

2.      Any specifications, drawings, particulars of weights and dimensions and other technical information contained in the Company's quotations, catalogues, price lists, advertisements or elsewhere are approximate only and intended merely to present a general idea of the Goods. The Company reserves the right to discontinue the sale of particular products or alter their designs and specifications without notice and to deliver Goods conforming to the altered design or specification in fulfillment of any Contract.
